0:03 The Senior Scholars Project in Kuwait is pleased,
0:07 in cooperation with the Foundation of Shaykh 'Abd al-'Aziz Ibn Baz,
0:12 may Allah have mercy on him,
0:14 to present to you:
0:16 "The Fiqh Choices
0:21 in Matters of Worship and Transactions,
0:25 from the Fatwas of His Eminence, the Eminent Imam,
0:30 'Abd al-'Aziz Ibn 'Abdullah Ibn Baz,
0:33 may Allah have mercy on him,"
0:35 compiled and arranged by Shaykh
0:38 Khalid Ibn Sa'ud Ibn 'Amir al-'Ajmi.
0:41 The Book of Purification:
0:45 Chapter on Wiping over Leather Socks (Khuffayn),
0:48 Splints, and Turbans.
0:52 The eminent Imam Ibn Baz, may Allah have mercy on him, said:
0:57 The Sunnah is to begin with the right foot before the left,
1:02 because of the saying of the Prophet, peace and blessings of Allah be upon him:
1:05 "When you perform ablution, begin with your right side."
1:08 Related by the compilers of the Sunan with an authentic chain of narration.
1:13 If one wipes the right foot with the right hand
1:16 and the left foot with the left hand,
1:19 there is no harm, provided one begins with the right foot.
1:22 And if one wipes both of them using either the right hand or the left hand,
1:26 there is no objection.
1:28 The duration for wiping begins
1:30 from the first wipe after breaking ritual purity,
1:32 for it has been soundly narrated from the Prophet, peace be upon him,
1:36 in authentic hadiths that which indicates this.
1:40 Among the conditions for wiping over socks
1:42 is that they must be thick and concealing.
1:45 If they are transparent, it is not permissible to wipe over them,
1:49 because in such a state, the foot is treated as uncovered.
1:53 Wiping over leather socks is prescribed
1:57 when they cover the foot and the ankles,
2:00 are pure, and are made from the leather of any animal
2:03 that is classified as ritually pure,
2:06 provided one put them on while in a state of ritual purity.
2:09 If the tear or hole is slight,
2:12 such that it is considered slight by custom,
2:14 the correct view is that, Allah willing, it does not impair the validity,
2:18 because people are commonly afflicted with this,
2:21 especially the poor.
2:23 It is permissible to wipe over socks,
2:26 which are woven fabrics meant to cover the feet,
2:29 whether made of cotton, wool, or other materials.
2:32 The ruling on wiping over leather socks
2:35 and wiping over fabric socks is identical,
2:37 according to the more correct of the scholars' opinions.
2:40 Removing that which has been wiped over invalidates the ablution,
2:44 and it is counted among the nullifiers of wudu.
2:47 If one wiped over the shoes along with the socks
2:50 and then took off the shoes,
2:51 he must remove the socks, and his ablution is invalidated;
2:54 that is, if he had wiped over both of them together,
2:57 then the ablution is invalidated by removing either one of them.
3:00 However, if he restricted the wiping strictly to the socks
3:03 and then put on shoes,
3:05 it is not invalidated by doing so,
3:07 because the ruling at that point applies solely to the socks.
3:10 The shoe alone is not wiped over,
3:14 because it does not cover the ankles;
3:16 rather, one may wipe over the socks along with the shoes,
3:20 since it is authentically established from the Prophet, peace be upon him,
3:23 that he wiped over both socks and shoes,
3:27 in an authentic hadith.
3:29 It is permissible to wipe over boots
3:31 along with whatever portion of the socks is exposed,
3:33 and the ruling will apply to both of them together.
3:36 Whenever one takes off the boot after breaking ritual purity,
3:39 it becomes obligatory to take off the sock
3:41 and repeat the ablution for prayer and the like.
3:44 But if one wiped over the sock without wiping the boot,
3:47 that is sufficient,
3:49 provided the socks cover
3:51 the area obligatory to wash,
3:53 and removing the boot will not harm his purity.
3:55 It is permissible to wipe over leather socks and fabric socks
3:59 in both winter and summer.
4:01 If a man sustained a wound,
4:03 the time for prayer entered,
4:05 and he performed ablution
4:06 except that he did not wash the area of the wound
4:09 because it was actively bleeding:
4:11 what was obligatory in this case
4:13 was for you to place a dressing over the wound—
4:16 a piece of cloth wrapped around it,
4:18 or something similar
4:20 that arrests and stops the bleeding—
4:22 so that you could wipe over this dressing.
4:25 If that was not feasible,
4:27 you should have performed tayammum for the wounded area after performing ablution.
4:30 However, binding it with a bandage or dressing
4:33 and then wiping over it
4:35 is what was obligatory.
4:37 So if you did not do that,
4:39 then making up the prayers that you offered
4:42 without either wiping or tayammum
4:44 is the safer and more prudent course for you.
4:47 If someone wipes for longer than the prescribed duration for wiping,
4:51 he must repeat the prayer;
4:53 this is the correct view,
4:55 because the duration of wiping is strictly limited.
4:58 Whoever puts on leather socks or fabric socks—
5:01 that is, regular socks—
5:03 while not in a state of ritual purity,
5:04 and then wipes over them and prays out of forgetfulness,
5:07 his prayer is invalid,
5:09 and he must repeat all the prayers
5:12 that he performed with that wiping.
5:14 It is preferable and more prudent
5:17 that the person performing ablution should not put on the sock
5:20 until he has washed his left foot;
5:22 this is the view most apparent from the evidence.
5:25 If someone puts on the right sock
5:27 before washing the left foot,
5:29 he ought to take off the leather sock
5:31 or the fabric sock from his right foot
5:33 prior to wiping,
5:35 and then reinsert his foot into it
5:37 after washing the left foot,
5:39 so that he exits from the scholarly disagreement
5:41 and takes precaution regarding his religion.
5:43 The turban is like the leather socks:
5:45 it must be preceded by ritual purity.
5:47 Thus, if one puts on a turban fastened beneath the chin
5:49 while in a state of purity,
5:51 he may wipe over it for a day and a night.
5:53 If a woman winds her headscarf (khimar)
5:55 around her head
5:57 and it is difficult for her to remove it,
5:59 she may wipe over it for a day and a night,
6:01 provided she put it on while in a state of ritual purity,
6:03 exactly like the leather socks.
6:05 However, if it is not fastened securely,
6:07 such as an ordinary turban or the ghutrah,
6:09 wiping over them is not permitted,
6:11 because removing them entails no hardship;
6:13 the same applies to an ordinary headscarf.
6:15 A splint may be wiped over,
6:17 removing it entails no hardship,
6:19 the same applies to an ordinary headscarf.
6:21 A splint may be wiped over,
6:24 even during major ritual impurity (janabah) and menstruation.
6:26 Then, when the area beneath it heals,
6:28 it is not obligatory to repeat the ritual bath (ghusl).
6:30 The Fiqh Choices.
